Important Regulatory Notice: Swapkoire operates exclusively as a provider of quantitative computational algorithms and computational market software. We do not provide financial advice, broker-dealer execution services, portfolio management, or deposit custodial holdings under the Financial Services and Markets Act 2000 (FSMA) or equivalent international legislation.
1. Introduction and Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement entered into between the individual or legal entity accessing or using this digital service ("User", "you", or "your") and Swapkoire ("Swapkoire", "we", "us", or "our"). By navigating, registering an account, integrating API credentials, or engaging any features provided via swapkoire-official-app.com (the "Platform"), you confirm that you have read, comprehended, and agreed to be bound by these Terms in their entirety.
If you disagree with any segment of these contractual conditions, you must immediately terminate your access to the Platform and refrain from engaging any computational services or automated models generated by Swapkoire.
2. Eligibility and Regulatory Restrictions
Access to Swapkoire is contingent upon meeting stringent legal prerequisites:
- You must be at least 18 years of age or the age of legal majority in your domestic jurisdiction, whichever is greater.
- You must possess the full civil legal capacity to enter into an enforceable contract under the laws of England and Wales or your domestic domicile.
- You must not reside in, be located in, or be an entity organized under any jurisdiction where algorithmic trading software, speculative derivatives, or cryptocurrency-related digital tools are prohibited, sanctioned, or restricted by applicable law or international sanctions regimes.
- United Kingdom participants acknowledge that retail marketing of certain cryptoasset derivatives and exchange traded notes (ETNs) is restricted under FCA Policy Statement PS20/10. Users must self-assess eligibility when connecting external third-party brokerages.
3. Nature of Platform Services
Swapkoire supplies autonomous algorithmic data analytics, quantitative market parsing, sub-millisecond execution signal routing, and automated risk parameters. You understand and expressly acknowledge:
- Swapkoire is not an authorized financial advisor, credit institution, asset custodian, or discretionary asset manager.
- The outputs, computational indicators, backtested statistics, and automation triggers presented across the Platform represent mathematical analyses and do not constitute personalized investment, legal, tax, or accounting recommendations.
- All automated transactions triggered through connected interfaces are routed via your independent third-party exchange or liquidity provider accounts. Swapkoire maintains no custody of fiat currency balances or private cryptographic keypairs.
4. Account Security and User Responsibility
Users who establish authentication credentials or API connections undertake full responsibility for preserving the confidentiality of login keys, passphrases, and private application tokens. You agree to notify Swapkoire without undue delay should you suspect unauthorized access or breaches of security. You assume singular liability for all transactions, configuration parameters, stop-loss limits, and market positions entered under your access credentials.
5. Algorithmic Trading Risks and Disclaimers
Trading in digital assets, foreign exchange contracts, contracts for difference (CFDs), and equity derivatives involves profound financial risk. Rapid volatility, slippage, liquidity drying, network congestion, latency anomalies, and automated liquidation events can precipitate the total loss of all committed funds.
Past numerical results, simulated metrics, and historical performance models displayed on the Platform are demonstrative only and provide no guarantee or reliable indicator of future profitability. You agree that your deployment of any automated algorithmic script or strategy is conducted at your sole discretion, election, and hazard.
6. Intellectual Property Rights
All intellectual property rights inherent to the Platform—including but not limited to source code, computational models, mathematical algorithms, visual layouts, trademarks, logos, audio-visual elements, and written documentation—are the proprietary property of Swapkoire or its authorized licensors. You are granted a limited, revocable, non-exclusive, non-transferable license to access the Platform strictly in conformity with these Terms. You may not reverse-engineer, decompile, mirror, scrape, or redistribute our analytical software without explicit prior written permission.
7. Limitation of Liability
To the maximum extent permitted under applicable law, Swapkoire, its affiliates, directors, officers, engineers, and agents shall in no circumstances be held liable for any indirect, incidental, consequential, punitive, or special damages, or for any loss of profits, revenue, data, capital, or trading opportunities arising directly or indirectly from your reliance on the Platform, technical outages, exchange API disconnects, market volatility, or erroneous algorithmic inputs.
Nothing in these Terms excludes or limits our liability for fraud, gross negligence, death, or personal injury caused by our negligence, or any other liability which cannot be lawfully excluded or limited under the laws of England and Wales.
8. Third-Party Integrations and Hyperlinks
The Platform may integrate with, facilitate connectivity to, or contain hyperlinks directing to third-party digital exchanges, liquidity venues, and market data aggregators. Swapkoire exercises no supervisory control over external platforms, their solvency, regulatory authorization, or order routing practices. Your business dealings with third parties are conducted exclusively under the third party's terms of service and risk policies.
9. Governing Law and Dispute Resolution
These Terms, their subject matter, and their formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of England and Wales. Any controversy, dispute, or claim arising out of or relating to these Terms shall be submitted to the exclusive jurisdiction of the Courts of England and Wales, without prejudice to statutory mandatory consumer rights where applicable.
10. Modifications to Terms and Contact
We reserve the right to revise, modernize, or amend these Terms at any interval to reflect operational, technological, or legal developments. Continued interaction with the Platform following the publication of revised terms constitutes definitive agreement to the revised obligations. Enquiries concerning these terms may be forwarded through our administrative channels at [email protected].
